In the constitutional studies is very important the inclusion of fundamental rights in essential part of the text of the supreme law. In this way, there is a minimum catalog of human rights that the Constitution collects and aims to guarantee. However, when the Constitution lacks the guideline of humanism and solidarity, its ineffectiveness in the protection and assurance of human rights, namely equality and freedom, is foreseeable.
