The use of pricing algorithms has already a noteworthy effect on the competitive structure of online markets and its impact will steadily grow in the coming years. This contribution illustrates that pricing algorithms have the potential to foster collusive market outcomes, even in markets that were not perceived to be prone to tacit collusion in the past. It is submitted that Article 101 TFEU is capable of tackling some of the arising issues but that more sophisticated forms of pricing algorithms, for example algorithms that are performing price adjustments autonomously, are probably falling out of its scope. It is further argued that rashly regulation might backfire. Lastly, the promises and perils of algorithmic consumer technologies are considered, concluding that a tech giants’ common ownership of supplier pricing software and algorithmic consumer technology can be harmful for consumers.Preissetzung durch Algorithmen und Art. 101 AEUVDer Einfluss von Preissetzungsalgorithmen auf Online-Märkten wird in den nächsten Jahren durch ihre weitere Verbreitung sowie durch den enormen Lernfortschritt, den sie durchlaufen, weiter zunehmen. Die Verwendung von Preisalgorithmen kann (bewusstes) Parallelverhalten von Marktteilnehmern fördern. Es werden auch Märkte erfasst, deren Struktur bisher nicht als geeignet für kollusives Verhalten angesehen wurde. Dabei sind komplexere und selbstständige Formen von Algorithmen vermutlich nicht unter Art. 101 AEUV zu fassen. Aufkommende Vorschläge zur Regulierung sind jedoch nicht unmittelbar erfolgversprechend. Digitale Assistenten stellen dazu eine marktbezogene Alternative dar, doch der Zusammenfall der Inhaberschaft von digitalen Assistenten und Anbieterpreissetzungssoftware kann auch negative Konsequenzen für Konsumenten haben.
