El art. 19 N°1 inc. 1° establece que la Constitución asegura a todas las personas “el derecho a la vida y la integridad física y psíquica”. Además, en su inc. 2° sostiene que “la ley protege la vida del que está por nacer”. Por lo tanto, la Constitución ampara la vida del nonato y su madre. El problema es determinar cómo debe actuar el legislador cuando se produce un aparente conflicto entre los derechos de la madre y de la vida en gestación. Nuestro estudio pretende dar algunos criterios de solución a esta cuestión
Article 19 N° 1 parr. 1 of the Constitution recognizes to every person the right to life and it´s physical and psychological integrity. It also declares in parr. 2 that protects the life of the unborn. Therefore, the Constitution shelters the life of the unborn and the mother. The problem is to determine how could our legal system react when there is an apparent conflict between the rights of the mother and the baby. Our investigation tries to give some criterions to solve this issue
