En esta investigación jurídica sobre Derechos Humanos y el constitucionalismo contemporáneo pretendemos precisar en primer lugar el concepto de los derechos humanos según el realismo jurídico clásico y Santo Tomás de Aquino, en segundo lugar determinar las características de los Derechos humanos fundamentales, en tercer lugar demostrar la validez de la clasifi cación de Derechos Humanos según la doctrina internacional y fi nalmente establecer las reglas de interpretación de los derechos humanos según la jurisprudencia de la Corte Constitucional Colombiana.
In this legal investigation about the contemporary constitutionalism we try to defi ne in fi rst place the concept of human rights according to the classical legal realism and Santo Tomás de Aquino, secondly, determine the characteristics of the fundamental Human rights, thirdly, demonstrate the validity of the classifi cation of Human rights according to the international doctrine, and fi nally to establish the rules of interpretation of the human rights according to the Colombian Constitutional Court jurisprudence
