Este estudio tiene como objetivo analizar la libertad de expresión del Abogado en el ejercicio del derecho de defensa de sus clientes y la incidencia que tiene en el respeto a las otras partes del proceso. Para alcanzar este fin se han analizado las últimas resoluciones judiciales en la materia, al objeto de comprobar el alcance de esta libertad, sus límites y los cauces procesales para garantizar la libertad de expresión del Abogado y el respeto debido a las partes (o al Juez) en el procedimiento judicial. Precede al estudio una aproximación a los textos legales que disciplinan la cuestión en Derecho español, fundamentalmente la Ley Orgánica del Poder Judicial, el Estatuto General de la Abogacía Española y la Ley Orgánica 1/1982 sobre protección civil del derecho al honor, a la intimidad personal y familiar y a la propia imagen, así como el Código Penal.
This study aims to analyze the freedom of speech of the lawyer in the exercise of the right of defense of its clients and the impact it has on respect for other parts of the legal process. To this purpose, the work analyzes the last judicial decisions on the subject, in order to verify the scope of this freedom, its limits and the procedural channels to guarantee the freedom of expression of the Lawyer and the respect due to the parties (or Judge) in the judicial procedure. It precedes the study an approximation to the legal texts that deals with the question in Spanish Law, fundamentally the Organic Law of the Judiciary Power, the General Statute of the Spanish Lawyers and the Organic Law 1/1982 on civil protection of the right to the honor, to personal and family intimacy, and the right to the protection of one’s image, as well as the Penal Code.
