The main thesis of this article is that the Italian jurist Alberico Gentili considered the law of nations as customary. In order to describe how Gentili conceptualizes this, a close reading of his main texts will be undertaken. First, it will be explained how Gentili shapes his understanding of ius gentium through the key-concepts of ratio probabilis and humanitas. Secondly, the analysis will concentrate on the controversial relationship between natural law and ius gentium. As it is argued that ratio probabilis and humanitas provide Gentili with a proper method of identification of custom, three concrete examples of such a method will be presented.
