Resumen de The Implementation of the Private Damages Directive 2014/104/EU in the Netherlands

• This contribution outlines and discusses the steps that have been taken under Dutch law, for the implementation of the Private Damages Directive in the Netherlands. It first provides a brief description of the private enforcement system in Dutch law. It then dwells upon the substantive implementation of the Directive’s provisions, namely the changes brought to the Dutch Civil Code (DCC) and to the Dutch Code of Civil Procedure (DCCP). This contribution concludes that the implementation process follows a straightforward and functional approach, which is meant to complete the already existing solid system of private enforcement of the competition law rules in the Netherlands.
