Este trabajo se enfoca en la actual sociedad de la información y las telecomunicaciones, y más específicamente en el entorno de Internet, para desarrollar el alcance del “derecho al olvido”, también llamado “derecho a ser olvidado”.
Dicha expresión es la que garantiza, a las personas físicas que así lo requieren, que la información que se haya publicado sobre ella en Internet sea removida de la Web bajo ciertas condiciones y por los mismos medios por los que fue incorporada, protegiendo así sus derechos a la intimidad, al honor, y a la dignidad, en un sano equilibrio con el derecho a la información y a la libertad de expresión, todos ellos englobados dentro de los derechos personalísimos.
La actualidad de esta temática conduce a reflexionar también sobre el rol que desempeñan las bibliotecas, frente al surgimiento de este derecho, como defensoras de la persistencia de la memoria, siempre enmarcando su actividad dentro de una sana compensación entre la protección de los datos personales y la libertad de expresión e información, y sosteniendo decididamente los pilares de la memoria histórica y la identidad colectiva de la sociedad en su conjunto.
This work focuses on the current information society and telecommunications, and more specifically on the Internet environment, to develop the scope of the “right to be forgotten”.
Said expression is the one that guarantees, to the physical persons that so require, that the information that has been published about them in Internet is removed from the Web under certain conditions and by the same means by which it was incorporated, thus protecting its rights to intimacy, honor and dignity, in a healthy balance with the right to information and freedom of expression, all of them encompassed within the most personal rights.
The current relevance of this theme leads also to reconsider the role of libraries, among the emergence of this right, as defenders of the persistence of memory, always framing their activity within a healthy compensation between the protection of personal data and freedom of expression and information, and resolutely supporting the pillars of historical memory and the collective identity of society as a whole.
