El objeto de este trabajo se centra en realizar una reflexión en torno a la recepción de la denominada praesumptio muciana en derecho histórico español y derecho actual, analizando previamente las fuentes romanas que tratan la citada presunción: un texto de POMPONIUS en el Digesto, D. 24, 1, 51, y un rescripto del emperador SEVERUS ALEXANDER contenido en C. 5, 16, 6.
