This article aims to analyze the importance of consensus building in the works of Jürgen Habermas and Axel Honneth. It initially investigates how the habermasian theory of communicative action allows us to understand the functioning of the alternative dispute resolution mechanisms and the way they make use of the dynamics of conflict to re-establish the channel of dialogue between parties, as well as encourage the emergence of mutually satisfactory solutions. It also highlights how Axel Honneth´s theory of justice affects the understanding of the ethical sense of the legal freedom in contemporary societies, and also how the democratization of spaces of interaction would help citizens to strengthen their freedom and autonomy. The philosophical reference analyzed denotes that consensus building constitutes a legitimate instrument of social emancipation.
