Imagination can be defined as a constitutive characteristic of human beings, among human cognitive faculties and potentialities. Consequently, imagination has a deep connection with law (juridical science and rights), specially regarding its prospective dimension. Actually, only by using imagination will it be possible to overcome the huge social, political, cultural and juridical challenges for the protection of human rights in the complex contemporary context. In this sense, this paper aims to ana¬lyze the underestimated connection between imagination, law and rights, proposing a dialogical approach to these subjects. Therefore, the article is divided in three topics: (i) Imagination and knowledge; (ii) Juridical reason in modernity; (iii) The connections between law and imagination.Keywords: law, imagination, modernity, knowledge, human rights.
A imaginação pode ser entendida como uma potencialidade constitutiva dos seres humanos, enquanto seres conscientes e sujeitos cognoscentes. Em razão disso, a imaginação possui uma profunda relação com o direito, sobretudo no que tange à sua dimensão prospectiva. Diante da complexidade do contexto hodierno, somente a partir da imaginação será possível superar os grandes e inusitados desafios que se colocam no plano jurídico, social, político e cultural, para a proteção dos direitos humanos. Nesse sentido, este artigo tem por objetivo analisar a subestimada relação entre direito e a imaginação na modernidade, a partir de uma abordagem dialógica destes fenômenos. Para tanto, o artigo divide-se em três tópicos: (i) Sobre a imaginação e conhecimento; (ii) A razão jurídica na modernidade; (iii) As relações entre direito e imaginação.Palavras-chave: direito, imaginação, modernidade, conhecimento, direito humanos.
