Los argumentos filosóficos que se han esgrimido sobre la importancia de la separación los poderes del Estado pueden rastrearse a dos grandes antecedentes: John Locke y su Carta sobre la tolerancia Carta sobre la tolerancia (1689) y y El espíritu de las leyes El espíritu de las leyes (1748) de Montesquieu. La separación de Locke propone es la de la iglesia y Estado mientras que Montesquieu propone la conocida separación tripartita del Estado en los poderes legislativos, ejecutivos y judiciales.
The philosophical arguments that have been raised about the importance of the separation of state powers can be traced to two major background: John Locke and his Letter Concerning Toleration (1689) and The Spirit of the Laws (1748) by Montesquieu. Locke´s proposed separation is that of church and state while Montesquieu proposes the seminal tripartite separation of state in legislative, executive and judicial powers.
