George P. Fletcher
It's the ltalian translation of the lecture of Pro! George Fletcher at the cerimony for the presentation of the International Prize "Silvia Sandano", that took place in Rome, on the 4th december 2015, during a conference on the matter "Civil Law and Common Law: what 'Grammar' for Criminal Law?". The lecture deals with the relations between language and law and the way in which the structure of the language of law could influence the categories of law. In that way, lt run through some foundamental principles of modern legal systems, from the rule of law, to the presumption of innocence, from the fair trial, to the reasonableness, in arder to compare common law and civillaw traditions, analysing the different languages of law and the history of legal thought and reaching the deepest meaning of the rule of law principle.
E la traduzione della lectio magistralis che il Prof. George Fletcher ha tenuto in occasione della consegna del Premio Intemazionale "Silvia Sandano", avvenuta nel corso del Convegno di Studi dal tito lo "Civil Law e Common Law: quale 'gram- matica' per il diritto penale?", svoltosi a Roma il 4 dicembre 2015. La lectio affronta la complessa tematica delle relazioni tra linguaggio e diritto, evidenziando come la struttura del linguaggio giuridico possa influenzare gli stessi concetti giuridici. 11 discorso ripercorre, cosi, alcuni dei principi fondamentali degli ordina- menti giuridici moderni, dalla rule of law alla presunzione di innocenza, dal giusto processo alla ragionevolezza, nell'ottica di una comparazione tra ordinamenti di common law e ordinamenti di civil law che passa attraverso l'analisi dei diversi linguaggi giuridici e la storia del pensiero giuridico, alla ricerca delle basi e dell'essenza dello stato di diritto.
