This article argues that since the Tadic case before the International Criminal Tribunal for the Former Yugoslavia, a new category of armed conflict has migrated from international criminal law to international humanitarian law: that of armed groups fighting each other within the borders of a state without the intervention of the armed forces of the latter. However, the extent to which the rules of this category of conflict cover issues that may arise in such a conflict has not been comprehensively examined. One may infer, from the war crimes that the Rome Statute of the International Criminal Court criminalizes in this type of conflict, a dozen rules of international humanitarian law. After giving an historical account of the codification of this category of armed conflict, the author argues that there is a need to further develop these rules in order to provide a more comprehensive humanitarian lawr egime applicable to conflict exclusively between non-state armed groups. The absence of such a comprehensive regime should not, however, be taken as evidence of a legal vacuum. The author suggests that a law enforcement regime resting on international human rights law should be applied to relations between the armed groups and the territorial state, while the warring relationship between the armed groups should fall under the law of armed conflict, including those core customary rules that are now recognized as being equally applicable to international and non-international armed conflict.
Cet article soutient que depuis l'affaire Tadic devant le Tribunal pénal international pour l'ex-Yougoslavie, une nouvelle catégorie de conflit armé s'est glissée du droit pénal international au droit international humanitaire: celle des groupes armés qui se cornbattent a l'intérieur des frontières d'un État sans l'intervention des forcées armées de ce dernier. Toutefois, la mesure dans laquelle les règles de cette catégorie de conflit recouvrent les problématiques qui peuvent se poser dans une telle guerre n'a pas fait l'objet d'une étude approfondie. Il peut étre déduit des crimes de guerre que le Statut de Rome de la Cour pénale internationale réprime dans ce type de conflit une douzaine de règles de droit international humanitaire. Apres avoir dressé un historique de la consécration de cette catégorie de conflit armé, l'auteur soutient qu'il y a lieu de développer davantage ces règles pour un régime de droit humanitaire plus élaboré applicable aux conflits opposant exclusivement les groupes armées non étatiques. L'absence d'un tel régime ne devrait cependant pas être considérée comme établissant la preuve d'un vide juridique. L'auteur propose que soit appliqué aux relations entre les groupes armés concernés et l'État territorial le régime international des droits de la personne et aux rapports entre ces groupes entre eux le régime du droit des conflits armés, notamment les principales règles coutumieres dont il est désormais admis qu'elles sont autant applicables a un conflit armé international qu'à un conflit armé non international.
