La empresa adjudicataria pretende que se respete su derecho a la ejecución del contrato y el juez italiano le da la razón en primera instancia (2007). Ante la persistente inactividad, la empresa Pizzarotti recurre la no ejecución de la sentencia favorable y el Consiglio di Stato pregunta al Tribunal de Justicia si el cumplimiento del Derecho UE debe prevalecer sobre la cosa juzgada nacional.
