Fundamental Rights are individuals basics rights, in order to affirm the human condition itself. However, depending on the society in which they find themselves, some rights are more protectors than others, a relationship of supremacy. In this way, we sought to assert the cultural influence in the structuring of fundamental rights and the dimension on different people traditions. For the correct framework of these rights as inherent in human beings, particular issues to each society must be taken into consideration, otherwise those issues can denature the human rights itself essence. From a historical-dialectical approach, which aims to verify whether it is the legacy of cultural heritage could legitimize distinctions within idealization of fundamental rights or, rather, differences tend to alienate the universal character of these essential rights.
Os direitos fundamentais constituem direito básico dos indivíduos, com vistas a afirmar a própria condição humana. Entretanto, a depender da sociedade em que se encontrem, alguns direitos serão mais protegidos que outros, numa relação de supremacia. Nesta senda, buscou-se perquirir a influência cultural na estruturação dos direitos fundamentais e sua dimensão segundo tradições de povos distintos. Para o correto enquadramento destes direitos como inerente aos seres humanos, questões particulares de cada sociedade devem ser levadas em consideração, sob pena de desnaturar a própria qualidade humana desse direito. Sob uma abordagem histórico-dialética, o que se objetiva verificar é se o legado da herança cultural legitimiria distinções no âmbito de idealização dos direitos fundamentais ou, ao contrário, diferenciações tenderiam a afastar o caráter universal destes direitos essenciais.
