Considering the autonomy of sport as a not convincing hypothesis, the author examines sports justice, in order to point out the phenomenon being ascribable to the whole legal system. The analysis is set on a dynamic comparison and involves the Italian and the German case law, as well as the Court of Justice�s, supporting the author�s dissertation.
Lo scritto esamina la controversa ipotesi dell�autonomia del sistema sportivo rispetto all�ordinamento italiano, soffermandosi sulla giustizia sportiva, che costituisce un angolo visuale privilegiato per coglierne, piuttosto, l�unitarietà. L�indagine si svolge nella prospettiva del confronto della giurisprudenza nazionale con l�esperienza europea e, tra i singoli stati membri, con quella tedesca, avallanti la ricostruzione suggerita dall�autore.
