La Ley 27/2013 de Racionalización y sostenibilidad de la Administración Local (LRSAL), modificó el artículo 25 de la Ley 7/1985 de 2 de abril Reguladora de las Bases del Régimen Local referido a las competencias de los municipios. Algunas interpretaciones principalmente la de la Federación Española de Municipios y Provincias (FEMP) y el Dictamen de la Comisión Permanente del Consejo de Estado de 22 de mayo de 2014, mantienen que los municipios no tendrían más competencias propias que las que deriven de la actual redacción del artículo 25.2. Otras, mantienen que la nueva redacción no afecta a las competencias atribuidas por norma con rango de ley Estatal o Autonómica, antes de su entrada en vigor, aun cuando no figuren en el listado del articulo 25.2 LRBRL. Esta última es la posición que se mantiene en el presente artículo.
Law 27/2013 for the Rationalization and Sustainability of the Local Administration (LRSAL) amended Article 25 of Law 7/1985 of April 2 regulating the bases of local government referring to the powers of the municipalities. Some interpretations, mainly from the Spanish Federation of Municipalities and Provinces (FEMP) and the opinion of the Standing Committee of the State Council from May 22, 2014, maintain that municipalities would not have more power than those resulting from the current regulation of Article 25.2. Others maintain that the new wording does not affect the powers attributed by regulation with the rank of State or Autonomous Law, before its entry into force, even if it is not listed in Article 25.2 LRBRL. The last one is the position that remains in this article.
