El presente trabajo analiza el derecho a la reagrupación familiar en el ámbito de la Unión Europea, en virtud del cual el extranjero que resida legalmente en un país podrá trasladar consigo a sus familiares más próximos.
Esta reunificación familiar constituye una de las fórmulas más eficaces para lograr la integración de los extranjeros en un país. El trabajo analiza las condiciones y requisitos para el ejercicio de este derecho haciendo hincapié en la existencia de un régimen jurídico distinto dependiendo de la nacionalidad del reagrupante. De este modo, se prevé una normativa mucho más favorable cuando el reagrupante es un ciudadano de la Unión Europea, frente a otra mucho más restrictiva cuando el reagrupante es nacional de un tercer Estado.
This paper analyzes the right to family reunification within the scope of the European Union, under which the foreigner lawfully resident in a country can move with them to their next of kin. This family reunification is one of the most effective way in achieving the integration of foreigners in a country. The paper analyzes the conditions and requirements for the exercise of this right by emphasizing the existence of a separate legal regime depending on the nationality of the applicant. Thus, a much more favorable rules are expected when the applicant is a citizen of the European Union, compared to a much more restrictive when the applicant is a national of a third State.
