In the last two centuries, several meanings have been associated with the word “guarantism”, linking it with the demand for welfare, constitutional guardianship of fundamental freedoms and z limitation of the state’s punitive power. Penal “guarantism”, forged in the legal culture of the Enlightenment, has found its major theoretical expression in Luigi Ferrajoli’s refl ection, who over the last 20 years has articulated and expanded the “guarantist” paradigm, putting it in relation with the various dimensions of constitutional democracy.Key words: guarantism, constitutionalism, Ferrajoli.
Nos últimos dois séculos, à palavra garantismo foram associados vários significados, vez por outra ligados às exigências de segurança social, de tutela constitucional das liberdades fundamentais, de limitação do poder punitivo do Estado. O garantismo penal, germinado na cultura jurídica do Iluminismo, encontrou a sua maior expressão teórica na reflexão de Luigi Ferrajoli, o qual nos últimos 20 anos articulou e expandiu o paradigma garantista, correlacionando-o às diversas dimensões da democracia constitucional.Palavras-chave: garantismo, constitucionalismo, Ferrajoli.
