    O presente artigo pretende analisar o desenvolvimento histórico da lei em Atenas dos séculos VI ao IV a.C. Desenvolve seu argumento na discussão entre transcendência e imanência da lei, resultante da passagem do thesmós ao nómos grego. Por fi m, argumenta que em Aristóteles está a possível síntese dessa discussão.Palavras-chave: thesmós, nómos, lei, Aristóteles, democracia ateniense.

    The following paper intends to analyze the historical development of the legal rules in Athens from the 6th to 4th centuries B.C. It develops its argument through the discussion between transcendence and immanence of the law in the passage from the Greek thesmós to nómos. Finally, it argues that in Aristotle lies the possible synthesis of this discussion.Keywords: thesmós, nómos, law, Aristotle, Athenian democracy.
