The article analyzes the principle of non-discrimination in the economic order from the perspective of the Chilean constitution. For this purpose, it discusses the potentiality of the State in establishing restrictions or regulations on individuals in economic matters, provided this does not affect the prohibition of arbitrary discrimination. It briefly proposes a concept of “non-discrimination” and reviews the topic of economic freedom and its limits, the principle of equality before the law, the principle of non-discrimination, and the concept of proportionality that should guide the actions of the State, when, for the sake of the common good, it becomes necessary to establish certain limits.Key words: economic Constitution, non-discrimination, proportionality.
El artículo analiza el principio de no discriminación en el orden económico desde el punto de vista de la constitución chilena. Con este objeto, el trabajo reflexiona sobre la capacidad del Estado para estabelecer restricciones o regulaciones a los particulares en materia económica, siempre y cuando no se afecte la prohibición de discriminación arbitraria. Siguiendo esta línea, se propone sumariamente un concepto de “no discriminación”, y se procede a revisar la noción de libertad económica y sus límites, el principio de igualdad ante la ley, el principio de no discriminación y el concepto de proporcionalidade que debe guiar los actos del Estado, cuando, por razones de bien común, establezca o fije ciertos límites.Palabras clave: Constitución económica, no discriminación, proporcionalidad.
