Introducir la mediación en el ámbito del derecho concursal es una medida valiente pero arriesgada. La Ley de Emprendedores, ley 14/2013 da un primer paso mediante el acuerdo extrajudicial de pagos competencia del mediador concursal. En sentido estricto, pese a la terminología utilizada, no es un verdadero supuesto de mediación, pero sí una importante medida de desjudicialización de la fase común del concurso. Esta primera regulación debe ser completada y revisada de manera integradora con el resto de nuestro ordenamiento jurídico, salvando las lagunas y conflictos que desde su entrada en vigor, ya vienen advirtiendo los operadores jurídicos implicados.
Introducing mediation in the context of bankruptcy law is a brave but risky measure. The Spanish Entrepreneur’s Law, L14/2013, marks the first step by allowing the so‐called “extra‐judiciary payment agreement,” which is assigned by a professional bankruptcy mediator. In strict terms, and in spite of the terminology used, it does not constitute a real mediation situation but it is a very important measure that reduces the importance of the Court in the preliminary stages of the bankruptcy proceedings. This first regulation needs to be completed and reviewed thoroughly to integrate it within the rest of the Spanish legal system. The revision should be aimed at filling the gaps and solving the inconsistencies that have been identified by the legal actors affected by the legislation since it came into force.
