Sommaire Dans son récent arrét Immunités juridictionnelles de l'État (Allemagne e Italie; Crece (intervenant)), la Cour internationale de ]ustice (CI]) ajugé que l'Italie avaitmanqué a son devoir de respecter les immunités dont jouit l'Allemagne en vertu du droit international public lorsque les instances italiennes ont autorisé des poursuites contre 1'Allemagne pour violations présumées, durant la Seconde guerre mondiale, du droit international des droits de la personne (DIDP) et du droit des conflits armés (DCA). Cet artiele évalue les trois arguments avancés par l'Italie pour justifier son refus d'immunité:
premierement, que les normes impératives du droit international prévalent sur les regles internationales sur les immunités juridictionnelles;
deuxiemement, que le droit international coutumier reconnait une exception a l'immunité pour les violations graves du DIDP ou du DCA; et, troisiemement, que le droit international coutumier reconnait une exception a 1'immunité pour les délits commis par les forces armées étrangeres sur le territoire de l'État du for dans le cadre d'un conflit armé. L'auteur concelut que la CIJ a eu raison de constater qu'aucun de ces arguments ne privait 1'Allemagne de son droit, en vertu du droit international, de voir respecter son immunité de la compétence civile des tribunaux italiens.
Summary In its recent decision injurisdictional Immunities of the State (Germany v Italy: GreeceIntervening), the International Court of]ustice (ICJ) held that ltaly had failed to respect immunities enjoyed byGermany under internationallaw when the ltalian courts allowed civilactions to be brought against Germany for alleged violationsof international human rights law (IHRL) and the law of armed conflict (LOAC) committed during the Second World War.This artiele evaluates the three arguments raised byltaly tojustify its denial of immunity: first,that peremptory norms of international law prevail over international rules on jurisdictional immunities; second, that customary internationallaw recognizes an exception to immunity for serious violations of IHRL or the LOAC; and third, that customary in ternationallaw recognizes an exception to immunity for torts committed by foreign armed forces on the territory of the forum state in the course of an armed conflict. The author concludes that the IC] wascorrect to find that none of these arguments deprived Germany of its right under internationallaw to immunity from the civil jurisdiction of the ltalian courts.
