El concepto de cultura ha expe- rimentado transformaciones a lo largo del tiempo en el orden jurídico inter- nacional. Tales variaciones van desde la concepción material de finales del siglo XIX hasta el reconocimiento, ocurrido más recientemente, de elementos inmateriales de la cultura tradicional dentro del concep- to de patrimonio cultural. A partir de una exposición estructurada cronológicamente, el presente artículo discute aportaciones que a lo largo de dichas transformaciones han sido realizadas por América Latina, y sostiene que lo propuesto por países de la región más allá de sus fronteras, por una parte, es reflejo de elementos existentes en sus órdenes internos y, por otra parte, va en una dirección contraria a aquello practicado en su interior.
The concept of culture has undergone changes over time in the international legal order.
Variations range from the material conception of the late nineteenth century to the recognition, which occurred more recently, of intangible elements of traditional culture within the concept of cultural heritage. In a chronological structure, this article discusses contributions made by Latin America and it argues that what is proposed by countries of the region beyond its borders, on the one hand, reflects elements pertaining to their internal legal orders and, on the other hand, goes in the opposite direction to that what is practiced into them
