El autor analiza la historia constitucional de Montenegro, su independencia y la aparición del primer texto constitucional que supone un avance democrático, tanto para las instituciones del Estado como para la propia sociedad. La Asamblea de Podgorica implica la pérdida de la independencia de Montenegro, que pasa a formar parte de Yugoslavia. Durante ese periodo estuvieron vigentes cinco constituciones, y sólo la Constitución de 1992 tenía un sistema parlamentario, obedeciendo las precedentes a un poder central durante la época socialista. En 2006 se produjo la independencia, tras la celebración de un referéndum, y el Tribunal Constitucional cobró un papel fundamental dentro de la organización de las nuevas instituciones democráticas. El presente trabajo profundiza, además, en el estudio del Tribunal Constitucional: su composición, funciones y semejanzas con otros Tribunales Constitucionales Europeos.
The author analyzes the constitutional history of Montenegro, its independence and the appearance of the first constitutional text is a step forward for both democratic state institutions and society itself. The Assembly of Podgorica is the loss of the independence of Montenegro, which became part of Yugoslavia, during that period were in place five constitutions, and only the 1992 Constitution had a parliamentary system, the foregoing obey a central authority during the socialist. In 2006 there was independence after a referendum and the Constitutional Court charging a key role in the organization of new democratic institutions.
