En este trabajo se investiga el papel de la Corte Constitucional de Indonesia en el proceso de desarrollo democrático a través de un examen de su estructura y sus funciones. Se adopta un enfoque relativista al fin de evaluar las similitudes y las diferencias entre el tribunal de Indonesia y el modelo europeo de justicia constitucional, y para comprender el proceso de circulación de la justicia constitucional en esta área del mundo.
The purpose of this paper is to analyze the role of the Indonesian constitutional court in the democratic development, through the lens of its structure and competences. The analysis adopts a relativistic approach in order to emphasize the similarities and the differences between the Indonesian court and the European model of constitutional justice, and to underline the modalities of the circulation of the judicial review in this area of the world.
