A comparative analysis of the south-american legal systems on law of succession. The article considers legal requirements in different South american countries for the existence of portions of the estate secured by law, and the forced heirs. These legal portions can also be a protection for the disabled persons. Also makes some suggestions about the improvement in the position of the widow or widower, the same sex partners and its rights on inheritance, the procedures for the declaration of heirs done by a public notary and proposes the creation of Registries of acts of last will. The work raises the necessary reforms to make these objectives possible.
