La mantención del régimen de sociedad conyugal en carácter de legal es obstáculo a la plena capacidad de la mujer casada en él. En efecto, en cuanto al ámbito patrimonial en que actuará la mujer y a os efectos jurídicos de sus actos y contratos, la ley Nº 18.802 la dejó igualmente limitada, casi en los mismos términos en que se encontraba en la situación anterior, pues los negocios jurídicos que la mujer no podía ejecutar como relativamente incapaz, le siguen igualmente prohibidos ahora que es plenamente capaz. Lo anterior se entiende perfectamente si se tiene presente que la plena capacidad de la mujer desnaturalizaría el régimen de sociedad conyugal que se mantiene en carácter de legal.
