In Chilean tax litigation, the burden of proof operates as a decisional shortcut:
rather than concluding evidentiary reasoning, it replaces it, recasting epistemic insufficiency as a reproach for non-compliance. The article reinterprets Articles 21, 132, and 4 bis of the Tax Code to reconstruct the burden of proof as a residual tie-breaking rule addressed to the judge, triggered only after: (i) analytically delimiting the disputed facts;
(ii) comparatively assessing the corroborative weight of available evidence; (iii) making the inferential path to findings of fact explicit; and (iv) identifying an irreducible final factual indeterminacy. Only then does the burden of proof apply – never as a substitute for evidentiary reasoning.
