El objeto del litigio de la sentencia estudiada se centra en determinar si un huérfano, sin padre ni madre, por haber fallecido los dos, tendría derecho a incrementar el porcentaje de la pensión de orfandad en el siguiente supuesto: cuando hay una persona beneficiaria de la pensión de viudedad generada por el mismo causante sin vínculo familiar con el huérfano.
The subject of the litigation in the studied judgment focuses on determining whether an orphan, without a father or mother, because both have died, would have the right to increase the percentage of the orphan’s pension in the following case: when there is a person who is the beneficiary of the widow’s pension generated by the same deceased person without a family link with the orphan.
