The recent Argentine LabourModernization Act establishes the socalled Labour Assistance Fund, a devicethat reshapes the coverage of thetermination of the employmentrelationship through an individualemployer account funded with resourcesdiverted from the Argentine IntegratedPension System. This article examinesthe legal architecture of the new fund andcontrasts it with the internationalstandard set out in ILO Conventions Nos.102 and 168, as well as with the LatinAmerican models of dismissal coveragein force in Peru, Brazil and Chile. Bymeans of a dogmatic and comparativemethod, the legal nature of the device isreconstructed. The results show that thefund erodes the deterrent function of thestatutory severance payment, dispenseswith the solidarity component andcompromises the sustainability of thepension system. It is concluded that theregime fails to meet the internationalminimum threshold and disregards thefunctional autonomy of Social SecurityLaw.
