This paper analyses the current regulations governing the early retirement of disabled workers, a possibility legally regulated in Article 206 bis of the LGSS (General Social Security Law). The analysis begins with a study of general issues, highlighting the differences with the evolution of ordinary early retirement, the purpose of this type of mechanism, and, in particular, the legal nature of this early retirement mechanism. Based on these general aspects, we focus on the study of the regulation of the two possibilities offered by the legal regulation, developed by Royal Decrees 1539/2003 (disabled persons with a degree of disability equal to or greater than 65%) and 1851/2009 (disabled persons with a degree of disability equal to or greater than 45% and with reduced life expectancy). The analysis highlights the common elements of both regulations, but above all points out the differences. In this study, we also focus on specifying the most criticisable aspects of this regulation, with the aim of pointing out those issues that can be improved.
