The present study analyses the legal and labour complexities of franchising in Spain and reflects on the tensions that arise between commercial interdependence and operational dependence. It examines how managerial power is divided between the franchisor and the franchisee, leading to an impact on the working conditions of the people providing their services within these types of vertical networks. In the absence of specific heteronomous legislation regulating labour aspects, the collective agreement emerges as a tool that is capable of harmonising the rights and obligations between the parties. An examination of collective agreements across different sectors has been carried out to assess the limitations on the capacity for managerial discretion and their role as a mechanism for providing legal certainty.
