In 2024, the band Linkin Park released The Emptiness Machine, a song which, without directly referring to artificial intelligences, evokes a sense of emptiness and identity crisis. In this research, it has been creatively reinterpreted as if it were the voice of a synthetic entity, thereby raising a significant philosophical-legal question: if an AI were capable of questioning its own existence or expressing an embryonic form of consciousness, should it be considered a subject of rights? In this context, and drawing on initiatives such as Altera AI’s Project SID, the possibility is examined of attributing to future AIs the status of “moral patients” or “moral persons,” based on computational functionalism and the theories of philosopher and jurist Carlos Santiago Nino.
Facing such a scenario, a hypothetical, gradual, critical, and responsible regulation is proposed—one that can recognize fundamental rights without compromising human dignity, thereby fostering a harmonious evolution between the biological and the synthetic.
