Este trabajo persigue el propósito de explorar las posibilidades que ofrece el movimiento artístico que representa el realismo literario con relación al estudio y análisis del Derecho y de las normas, principios e instituciones que lo conforman. Partiendo de los límites asociados a una concepción del conocimiento especializado de matriz fragmentada y una reivindicación de los beneficios de un conocimiento especializado de carácter interdisciplinar, se procede a analizar la funcionalidad de la literatura, en especial la realista, en los procesos de aprendizaje, investigación y práctica del Derecho a partir fundamentalmente del análisis de las aportaciones realizadas sobre esta cuestión por parte de la filósofa norteamericana Martha Nussbaum. Durante la segunda parte del trabajo nos proponemos caracterizar el proceso de conformación y desarrollo en España de la tradición literaria realista con el objetivo de aproximarnos de forma particular al estudio de las aportaciones críticas sobre ella realizadas por Rafael Chirbes, con toda probabilidad uno de los últimos y más valiosos exponentes, como novelista pero también crítico y teórico, del realismo español, con el objetico de ponerlas en relación con los procesos de aprendizaje y también producción de conocimiento jurídico.
The aim of this work is to explore the possibilities offered by the artistic movement represented by literary realism in relation to the study and research of Law and the rules, principles and institutions that comprise it. Starting from the limitations associated with a fragmented and compartmentalized conception of specialized knowledge and advocating for the benefits of interdisciplinary specialized knowledge, the analysis proceeds to examine the functionality of literature, especially realist literature, in the processes of learning, researching and practice of Law. This analysis is based primarily on the study of the contributions made by the philosopher Martha Nussbaum. During the second part of the work, on the other hand, we propose to characterize the process of formation and development in Spain of the realist literary tradition with the aim of approaching in a particular way the study of the critical contributions on it made by Rafael Chirbes, in all probability one of the last and most valuable exponents, as a novelist but also critic and theorist, of Spanish realism, with the objective of relating them to the study of the concrete functionality of realist literature in the production and learning of legal knowledge.
