In the Region of Murcia, the competent regional authorities have initiated multiple ex officio review proceedings concerning changes in the production type of pig holdings. These proceedings have resulted in declarations that the decisions authorising and registering such changes in the Regional Register of Pig Holdings (Registro Regional de Explotaciones Porcinas, RREP) were null and void because the relevant administrative bodies had failed to complete the prior and essential environmental procedures.
To illustrate this issue, the following judgments delivered in 2026 by the Administrative Chamber of the High Court of Justice of Murcia have been selected: Judgment No. 66/2026 of 19 February 2026, case No. 319/2023 (ROJ: STSJ MU 317/2026); Judgment No. 64/2026 of 19 February 2026, case No. 282/2023 (ROJ: STSJ MU 327/2026); Judgment No. 131/2026 of 12 March 2026, case No. 339/2023 (ROJ: STSJ MU 474/2026); Judgment No. 166/2026 of 26 March 2026, case No. 569/2023 (ROJ: STSJ MU 627/2026); and Judgment No. 243/2026 of 7 May 2026, appeal No. 84/2024 (ROJ: STSJ MU 798/2026).
This body of case law comprises two clearly distinct strands. On the one hand, the first four judgments concern, as noted above, the ex officio review and declaration of nullity of decisions authorising and registering changes in the production type of pig holdings in the RREP, on the grounds that prior and essential environmental procedures had been omitted. On the other hand, Judgment No. 243/2026 of 7 May 2026 concerns an order requiring a pig holding to cease operations because the activity was incapable of being regularised. The judgment focuses on the activity licence, municipal planning rules and the restoration of environmental legality.
