This paper aims to analyze the impact that the future Regulation on the welfare of dogs and cats and their traceability will have on the Spanish legal system, specifically on Law 7/2023, of March 28, on the protection of the rights and welfare of animals.
As with any study on animal welfare within the EU framework, the foundation rests on Article 13 TFEU, which recognizes animals as sentient beings. The essential content of the Regulation is then analyzed: obligations of operators, identification and traceability, national databases, and the entry of dogs and cats from third countries into the EU.
The central part of the article seeks to identify potential conflicts between the supranational regulation and national legislation, with particular emphasis on the necessary review of the Spanish sanctions regime to ensure full compliance with the obligations arising from the Regulation.
