Exclusionary Practices after ECJ Google AndroidThe judgement of the ECJ in the Google Android case raises fundamental questions about a requirement of causality of market power. However, the approach of the ECJ is not unproblematic. It leads to the necessity of proving causality of market power for the abusive conduct in each case. In contrast, this test should be regarded merely as a possible test for assessing whether specific conduct departs from competition on the merits. The Guidelines on the application of Art. 102 TFEU to abusive exclusionary conduct reflect this understanding.
