7.2 del Reglamento Bruselas I bis.
This study analyzes the determination of applicable law and international jurisdiction in cases of non-contractual liability arising from online gambling. Based on the Wunner case, it examines the interpretation of Article 4 of the Rome II Regulation, with particular attention to the criterion of the place where the damage materializes and the requirement of direct damage in order to determine the application of a single legal system. To this end, it analyzes the specific characteristics of multi-local and delocalized torts committed via the internet, which often make it difficult to locate the damage within a single territory. Finally, it refers to the theory of ubiquity to determine the place of the causal event and the place where the damage materializes within the framework of Article 7(2) of the Brussels I bis Regulation.
