This article aims to analyze the configuration of the landscape as a legally protected interest (bien jurídico), addressing the specific difficulty of its delimitation from a legal perspective, given that it is a reality constructed from natural, cultural, percep- tual, and aesthetic elements. The study examines the emergence of landscape in Spanish legislation, initially linked to the pro- tection of exceptional spaces or areas of singular beauty, and its subsequent evolution toward a broader and more functional con- ception. Throughout this overview, the article addresses the var- ious normative and jurisprudential attempts to legally define the landscape, as well as its progressive expansion from the idea of a sublime space or natural beauty to its current consideration as a transversal instrument of land-use planning, decisively driven by the European Landscape Convention of Florence. Furthermore, the article compares the varying scope of landscape within en- vironmental, urban development, and land-use planning legis- lation, highlighting their respective protective, integrative, and planning functions. Finally, it analyzes the evolution of Spanish case law and that of the European Court of Human Rights, which have contributed to shaping the landscape as a public interest, a limit to certain actions, and a potential dimension of rights linked to the environment, property, the home, and private life.
