After the first quarter of the 21st century, humanity has witnessed a phenomenon that has impacted various sectors, and the legal field has been no exception: Artificial Intelligence is transforming the world. The development achieved by AI and its widespread propagation across all human activities have certainly benefited society by facilitating and expediting these activities with greater efficiency than humans. However, it has also brought about the issue of where to place AI when it interacts within civil legal relationships, as well as the impact on human rights that are violated by the actions of AI. Based on a bibliographic study that included the analysis of classical and modern texts, publications, articles, among others, it was concluded that AI will be situated within the objective element of civil legal relationships. This is because, despite possessing certain intelligence and reasoning capabilities, it remains an object in legal transactions. On the other hand, national legislation is required to regulate AI and its interaction with human rights.
