The present study aims to analyze the extraterritorial application of the General Data Protection Regulation in the context of international transfer, as well as how the influence of the Schrems I and II judgments on the establishment of the parameters regulating this flow to territories outside the EU occurred. Furthermore, it is considered the degree of influence of these judgments and the GDPR in the making of the Brazilian General Data Protection Law, when examining the flows of personal data in international transfers and the applicability of the legal mechanisms that regulate them. Finally, it is sought to clarify the possibility of recognition of the harmony of the Brazilian legal framework with the essential points demanded by the European Union in identifying the appropriate level of data protection, in order to consent to the legally secure transmission of personal data between the parties.
