The ruling of the Supreme Court applies the doctrine of the judgment of the Court of Justice of the European Union (Grand Chamber) of April 14, 2026, C-418/24, Obadal, and, as long as the legislator does not intervene, redefines the Spanish legal system's response to the abuse of temporary employment in public sector labor. Moving beyond the specific case it resolves, the ruling of the Plenary of the Social Chamber of the Supreme Court establishes and organizes the remedies against the abuse of temporary employment within the Spanish public labor sector: the general exclusion of permanent status (fijeza), which is incompatible with the constitutional and legal principles of equality, merit, and capacity, and the exceptional admission of a selective and compatible permanent status; capped severance payments upon termination and compensatory damages for the full material and moral harm caused by the abuse of temporary employment, pari passu if contract termination occurs; the minimum presumptive compensation for moral damages and its quantification; and administrative sanctions.
