The Judgment of the Barcelona Court of Appeal (Section 15) no. 437/2026, of 24 April, resolves the challenge against the approval order of the restructuring plan of Cablematic 2000, S.L., in which no restructuring expert had been appointed. The court holds that the expert's report is a mandatory requirement for all plans requiring judicial confirmation under article 639 of the Spanish Insolvency Act, including those falling under paragraph one thereof, and that its absence is reviewable in challenge proceedings before the Court of Appeal, and entails the total ineffectiveness of the plan, thereby diverging from the doctrine of Section 28 of the Madrid Court of Appeal. The article highlights that the sparse regulation of the expert's legal statute lies at the root of the controversy and that, notwithstanding the well-founded objections raised in the individual opinion, the majority's position best preserves the effectiveness of article 672.1.4. Furthermore, the court also finds a defective formation of classes.
