The discharge of unsatisfied liabilities for individual debtors takes place within a context of broad and profound reform of our insolvency system and the insolvency regime in general. In this paper, the author examines the objective scope of the discharge, with particular attention to those debts which, due to their nature or characteristics, have been excluded by the legislature from the potential benefit granted to the debtor. The analysis focuses especially on those cases that have generated the greatest doctrinal and jurisprudential controversy, concluding with a critical assessment of the current system and of the measures that could contribute to improving the fresh start mechanism.
