International labor law has historically been crucial in the development of social law in states. The corpus of social law provided by non-judicial international guaranteeing compliance, such as the Committee on Freedom of Association and the Committee of Experts on the Application of the ILO Conventions and Recommendations, was key to establishing a democratic model of labor relations following the Spanish Constitution. The ratification, in 2021, of the Revised European Social Charter and, above all, the acceptance of its Additional Protocol on collective complaints before the European Committee of Social Rights opened a new stage in this process of consolidating a multi-level system of social guarantees, after a period of legal and social regression until 2019. However, the Fourth Chamber of the Supreme Court has shattered all expectations, creating a significant gap between the legal framework (legal value of res interpretata by the authoritative doctrine of international bodies) and its effectiveness (jurisprudential violations). This article critically exposes the situation and offers a broad argument in favor of correcting this pernicious jurisprudence, which the Constitutional Court will have the opportunity to do.
