Para el análisis del fallo en cuestión, en un primer momento, y a los fines de tener una acabada idea del mismo, se sintetizan los argumentos vertidos por las partes en favor de su pretensión, y lo resuelto por el tribunal. A partir de ello, se identifican y resumen los principales fundamentos brindados por la Cámara, los que son analizados en la misma oportunidad. Así, se abordan los diversos derechos, principios e institutos jurídicos aplicados por el tribunal. Con respecto a los primeros, se encuentran el derecho a la salud, la vida, la integridad personal y un nivel de vida adecuado, respecto de los cuales se indica su reconocimiento e identifica su contenido en la Constitución Nacional y en los tratados internacionales de derechos humanos. El derecho a la salud se aborda con más amplitud, puesto que se tratan sus implicancias en la esfera económica de sus beneficiarios. Asimismo, se analiza la obligación de los estados, principalmente los provinciales, de garantizarlos. Finalmente, es tratado el interés público invocado por la demandada, y la ponderación planteada por el tribunal ante el conflicto con el derecho a la salud en el caso concreto.
To analyze the ruling in question, we first summarize the arguments presented by the parties in support of their claims, as well as the court’s decision, in order to provide a comprehensive overview. Based on this, we identify and summarize the main grounds cited by the Court, which are analyzed at the same time. Thus, the various rights, principles, and legal institutions applied by the court are addressed. Regarding the former, these include the right to health, life, personal integrity, and an adequate standard of living, for which their recognition is noted and their content identified in the National Constitution and in international human rights treaties. The right to health is addressed more extensively, as its implications in the economic sphere for its beneficiaries are discussed. Likewise, the obligation of states—primarily provincial governments—to guarantee these rights is analyzed. Finally, the public interest invoked by the defendant is addressed, along with the balancing of interests undertaken by the court in light of the conflict with the right to health in this specific case.
