This article examines, from a historical-evolutionary and applied perspective, how Directive (EU) 2024/2853 reshapes the regime of product liability when applied to Advanced Driver-Assistance Systems incorporating artificial intelligence. Its central claim is that the reform does more than recognise software as a product. It reorganises liability around the logic of the evolving product, whose safety also depends on the manufacturer’s post-market control. On that basis, the article reconstructs the evolution of the concept of defect, identifies the features that make AI legally distinctive within ADAS, in particular opacity, probabilistic performance, data dependence and the risk of degradation, and situates the Directive within the broader European regulatory ecosystem. The topic is of immediate practical relevance because the new regime will apply from 9 December 2026 onwards and because of its connection with cybersecurity, repair policy and after-sales services.
