The case C-161/17 (Renckhoff) examines the publication on a school website of a photograph that had previously been authorized only for a travel portal. It analyzes and compares the application of the new doctrine of the «rights holder’s conditions», criticizing the subjectivity of the «new public» criterion and focusing the unlawfulness on the breach of the conditions imposed by the rights holder of the work —whether explicit or implicit— at the time of granting consent for communication to the public.
